Terms of Service

By inviting, using, or otherwise interacting with Relaxy!, you agree to these Terms. If you do not agree to them, do not use the Service. If you invite Relaxy! to a Discord server, you accept these Terms on behalf of that server and are responsible for the way it is used there.

1. Definitions

"Relaxy!" refers to the Discord bot, this website, its subdomains and any other website through which the Owner makes the Service available; the dashboard; applications for mobile, tablet and other smart device systems; the Application Program Interfaces (API); and the Service as a whole.

The "Owner" is MattFor, the sole operator of Relaxy!, reachable at mattfor@relaxy.xyz. A "User" is any person who interacts with the Service. A "Server" is a Discord guild that Relaxy! has been invited to. "Server Staff" are the Users who hold permission to configure Relaxy! in a Server.

2. Eligibility

Users must be at least 13 years old, or older where the law that applies to them sets a higher minimum age for use of online services, and in any event must meet Discord's own minimum age requirement for their country. Users who have been blacklisted from the Service, or banned from Discord, may not use Relaxy! by any means, including through another account.

3. Usage Restrictions

Relaxy! and the Service may only be used within the scope of what they are provided for, under these Terms and applicable law. Users may not:

• use the Service for any illegal purpose, or to produce, request, store or distribute unlawful content;
• use the Service for any malicious purpose, including harassment, stalking, doxxing, hate speech, threats, fraud, phishing, scams, or the distribution of malware;
• use the Service for any purpose that is against the Discord Terms of Service, Community Guidelines or Developer Terms;
• use the Service to infringe the intellectual property, privacy, publicity or other rights of any person;
• attempt to disrupt, overload, rate-limit-abuse, spam, flood, denial-of-service or otherwise interfere with the Service or the infrastructure it runs on;
• reverse engineer, decompile, scrape, re-host, resell, sublicense or commercially exploit the Service or any part of it;
• circumvent, or attempt to circumvent, any restriction, blacklist, cooldown, quota, permission check or moderation measure applied by the Owner or by Server Staff;
• impersonate the Owner, the Service, or any other person, or misrepresent an affiliation with them;
• use the Service to collect or process personal data about others beyond what the Service is plainly provided for.

4. The Service is Free

Every feature of Relaxy! is provided free of charge, and the Owner does not paywall functionality. Nothing in these Terms creates a paid contract, a subscription, or a service level agreement. Donations made through Ko-fi or any other channel are voluntary gifts in support of continued development; they are not a purchase of the Service, of any feature, or of any entitlement, they are non-refundable, and any request honoured in return for a donation is honoured entirely at the Owner's discretion.

5. Availability and Changes to the Service

Relaxy! is self-hosted by a single person on hardware the Owner owns personally. The Service is provided on an "as available" basis with no guarantee of uptime, continuity, latency, data durability or fitness for any particular use. The Owner may at any time, and without prior notice, add, alter, suspend, limit, or permanently discontinue any part of the Service, change these Terms, or cease operating Relaxy! altogether.

6. Music and Third-Party Media

Relaxy! does not host, store, sell, index or redistribute music or video. Its music commands take a link or a search term that a User supplies, resolve it against publicly accessible third-party sources (such as YouTube, SoundCloud and Spotify), and stream the audio into that User's voice channel in real time, at that User's request and under that User's direction. Playback is transient: no copy is retained once playback ends, no download or copy is offered to Users, and no media is served from the Owner's own infrastructure.

The Owner receives no payment for playback, sells no advertising against it, and derives no commercial benefit from any media played through the Service.

Playback through Relaxy! is not a substitute for the source platform. It does not reproduce that platform's own player, its advertising, its recommendations, its analytics, its creator-support mechanisms, or any other part of the experience that platform provides, and it is not intended or offered as an alternative to them. Users who wish to support a creator or rights holder, or who wish to view content as the platform intends it to be viewed, should use that platform directly.

Each User is responsible for their own use of third-party platforms. By requesting playback, a User confirms that doing so is permitted under the terms of the platform the content is resolved from and under the law that applies to that User. The Service may not be used to reproduce, distribute, publicly perform or make available material a User does not hold the rights to, nor in any other way that infringes the copyright or related rights of a third party, nor to build any archive or library of media.

Relaxy! is not affiliated with, sponsored by, endorsed by, or in any way connected to Discord, YouTube, Google LLC, SoundCloud, Spotify, or any other platform against which a request may be resolved. All trademarks, service marks and content remain the property of their respective owners.

The Owner will act on any well-founded request from a rights holder or platform, including disabling a source, blocking specific content, or removing the feature entirely. See Copyright Complaints below.

7. User Content and Storage

The Service lets Users store files, images, text, embeds, welcome and boost messages, and other configuration ("User Content"). Users remain responsible for their User Content and warrant that they hold the rights necessary to upload and use it, and that it does not breach these Terms or any law.

Users grant the Owner a non-exclusive, worldwide, royalty-free licence to store, process, transmit and display User Content strictly to the extent required to operate the Service. This licence ends when the content is deleted. Storage quotas apply and may be changed. The Owner may remove any User Content that breaches these Terms, and may delete stored content belonging to inactive Users or Servers as part of routine data lifecycle maintenance.

8. Voice Recording

Relaxy! includes a voice recording feature that captures the audio of members present in a voice channel. Recording people can be unlawful without their knowledge or consent and the rules differ sharply between countries and, in some cases, between regions of one country.

The User who starts a recording, and the Server Staff who permit the feature to be used, are solely responsible for obtaining every consent required and for complying with all applicable recording, wiretapping, privacy and data protection law. The Owner does not review recordings, does not verify consent, and accepts no responsibility for how the feature is used. Do not record anyone who has not agreed to be recorded.

9. Moderation Features

Relaxy!'s moderation features - including censoring, image OCR, warnings, autobanning, raid protection, moderation logging, cross-server links and appeal channels - act on the instructions of Server Staff and on automated rules those Staff configure. Those features operate within a Server at the direction of the people who run it; the Owner is not a moderator of any Server and is not responsible for moderation decisions taken in one.

Automated detection is imperfect. The Owner makes no warranty that censoring, scam detection or raid protection will identify all prohibited content or activity, that they will not act on content that is in fact permitted, or that they are suitable as a Server's only safety measure. Cross-server moderation is opt-in and configured by Server Staff on each side.

10. Virtual Items and the In-Bot Economy

Currency, items, levels, ranks, profiles, inventories and anything else accumulated through Relaxy!'s economy and levelling features exist only inside the Service. They have no monetary value, are not property, are not transferable outside the Service, and may not be sold, purchased or exchanged for anything of real-world value. The Owner may adjust, reset, revoke or remove them at any time, including as a result of moderation action or a bug fix, without compensation.

11. Intellectual Property

All content, code, artwork and design available on or comprising Relaxy! is owned or provided by the Owner or its licensors and is protected by copyright. Users may not use, copy, modify, transmit, redistribute or create derivative works from it beyond what is necessary for the proper use of the Service.

12. Access to External Resources and Third-Party Services

Users may have access to external resources provided by third parties, and the Owner is not responsible for their content, accuracy or availability. The Service depends on third parties - Discord above all - and use of the Service is additionally subject to their terms. The Owner is not responsible for any interruption, change or failure caused by a third party.

13. Copyright Complaints

Rights holders who believe that material has been made accessible through the Service in breach of their rights may contact mattfor@relaxy.xyz. A notice should identify the work concerned, the material or source complained of in enough detail to locate it, the complainant's contact details, and a statement that the complainant holds the rights or is authorised to act for the rights holder. The Owner will review every notice promptly and, where it is well founded, block or remove the material or disable the source.

14. Privacy

The data the Service collects and how it is handled are described in the Privacy Policy, which forms part of these Terms. Users may request deletion of their data by contacting the Owner.

15. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. The Owner does not warrant that the Service will be uninterrupted, secure, timely, error-free, or that data will not be lost or corrupted. No advice or information obtained from the Owner or through the Service creates any warranty not expressly stated here.

16. Limitation of Liability

To the fullest extent permitted by applicable law, the Owner shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, nor for any loss of profit, revenue, data, goodwill, or business opportunity, arising out of or in connection with the Service, whether based in contract, tort, negligence or any other theory, and whether or not the Owner has been advised of the possibility of such damage.

To the fullest extent permitted by applicable law, the Owner's total aggregate liability arising out of or in connection with the Service shall not exceed the greater of the total amount actually paid by the User to the Owner for the Service in the twelve months preceding the claim (which, the Service being free of charge, will ordinarily be nil) and EUR 50.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Where a User acts as a consumer, statutory consumer rights that cannot be waived remain unaffected.

17. Indemnification

Users agree to indemnify, defend and hold harmless the Owner from and against any claim, demand, proceeding, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of or connected with: their use or misuse of the Service; their User Content; any content they request the Service to retrieve, play or process; their breach of these Terms or of any applicable law; or their infringement of the rights of any third party.

18. Enforcement, Suspension and Termination

The Owner reserves the right to take any appropriate measure to protect its legitimate interests and those of other Users, including issuing warnings, removing content, blacklisting a User or a Server, denying access to Relaxy! or the Service in whole or in part, terminating any relationship with a User, and reporting misconduct to the competent authorities. Such measures may be taken at any time, with or without notice, and at the Owner's sole discretion. Users may stop using the Service at any time by removing Relaxy! from their Server.

19. Changes to These Terms

The Owner may modify these Terms at any time. The version published on this page is the version in force, and the date at the top reflects the last change. Continued use of the Service after a change constitutes acceptance of the amended Terms. Users who do not accept a change must stop using the Service.

20. Severability, Waiver and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, that provision shall be limited or removed to the minimum extent necessary and the remainder shall stay in full force. A failure by the Owner to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, constitute the entire agreement between the User and the Owner regarding the Service.

21. Governing Law

These Terms are governed by the law of the country in which the Owner is established, without regard to its conflict of law rules, and the courts of that country shall have jurisdiction over any dispute arising from them. Where a User is a consumer resident in the European Union, this does not deprive that User of the protection of mandatory provisions of the law of their country of residence.
